Recent discussions surrounding Vice President Sara Duterte and the disallowance of confidential funds by the Commission on Audit (COA) have cast a spotlight on the intricate, multi-layered accountability mechanisms embedded within the Philippine government. As highlighted by Rep. Terry Ridon, such situations do not funnel into a single legal pathway but rather trigger concurrent processes across distinct governmental bodies, each with its own focus and potential consequences.

Rep. Ridon emphasizes the independence of these proceedings, stating, "Basically, we are talking about the same set of facts... and the same set of defenses... Which is why my explanation is that we cannot pit the proceedings in the Commission on Audit, in the Ombudsman, and in the impeachment against each other."

The Commission on Audit (COA): Financial Accountability

The COA acts as the primary guardian of public funds, tasked with auditing all government expenditures. When funds are deemed to have been spent illegally, irregularly, unnecessarily, excessively, or extravagantly, COA issues a notice of disallowance. In the case of the ₱73 million confidential funds, Rep. Ridon clarifies: "As far as the COA is concerned, it is a matter of returning the money of 73 million." The COA's mandate is purely financial recovery.

The Office of the Ombudsman: Criminal and Administrative Liability

Parallel to the COA's financial review, the Office of the Ombudsman investigates and prosecutes public officials for corruption and other offenses. For disallowances involving misuse of funds, charges like malversation can be filed. Rep. Ridon explains, "As far as the Ombudsman is concerned, it is a criminal case or an administrative case relating to malversation." This path seeks to impose criminal penalties, including imprisonment, or administrative sanctions.

Impeachment Proceedings: Political Accountability

For impeachable officials, such as the Vice President, accountability also extends to the political arena. Impeachment is a process initiated by the House of Representatives and tried by the Senate, aimed at removing an official from office for grounds like betrayal of public trust, culpable violation of the Constitution, or graft and corruption. Rep. Ridon notes, "As far as the impeachment is concerned, the consequence there is the removal from office of an impeachable official."

The critical takeaway, according to Rep. Ridon, is that while these bodies may examine the "same sets of facts" and "same sets of defenses," they pursue "different consequences." This multi-pronged approach ensures a comprehensive system of checks and balances, where financial restitution, criminal culpability, and political fitness are all examined independently, leaving no stone unturned in upholding public trust.
